Tryout the City of Owen Sound Program Rules and Regulations
PROGRAM DESCRIPTION AND PARTICIPATION
Program Start Date: “Tryout Owen Sound” (the "Program") will start on Monday, May 27, 2019.
Program Closing Date: The deadline for entering the Program is Friday June 28, 2019.
Sponsor: The Program Sponsor is the Corporation of the City of Owen Sound.
By entering the Program, entrants accept and agree to be bound by these Rules and Regulations, and accept the decisions of the Corporation of the City of Owen Sound and its agents as final and binding in all respects.
No purchase necessary. The Program is open to residents of Canada (excluding residents of Quebec) who are nineteen (19) years of age or older at the time of entry. Proof of age and place of residence may be required. This Program is not open to employees of the Corporation of the City of Owen Sound its officers or employees the sponsors and prize suppliers (“Promotional Parties”), its advertising and promotion agencies and their shareholders, directors, officers and employees nor any person who resides with any of these individuals. This Program is void outside the jurisdiction listed above and where prohibited by law. The Program is subject to all applicable federal, provincial and municipal laws and regulations.
To participate in the Program, participants must register online by visiting the Program website posted at www.areyoumost.com webpage and complete an application form. All applications will be reviewed by The Corporation of the City of Owen Sound and/or its authorized agent for eligibility. Applicants may only enter the Program once during the entire promotional period, entering multiple times will not increase your odds or chances of being selected to participate in the program. In the event it is discovered that you attempted to enter the Program more than once, all of your entries will be void. All applications must be received by the Program Closing Date.
Between June 28, 2019 and July 15, 2019, The Corporation of the City of Owen Sound or its agent will select up to 8 successful applicants. The selected applications will be awarded the Offer, provided the entry is valid and meets all criteria outlined in the Rules and Regulations.
Between June 28, 2019 and July 15, 2019 the selected applicants will be directly contacted using the email address they provided in the application by a staff member of the City of Owen Sound ("Notification"). The successful applicant must respond to this email to accept the offer to visit and coordinate with City of Owen Sound staff to set up their time to Tryout the City. The successful applicant will be required to correctly answer a skill-testing mathematical question within a specified time. If the candidate responds incorrectly to this question, his/her entry will be rejected.
If City of Owen Sound staff is not able to make contact with the successful applicant (via email followed by phone) by July 15, 2019, to start the process of arranging their offer to Tryout Owen Sound, the offer will then be forfeited.
If a selected entrant cannot be contacted for any reason by the specified times, or is unwilling to accept the offer or unable to comply with the requirements as set out by the Program Rules and Regulations, the Program Sponsor shall have the right to disqualify said entrant and select another eligible application.
By entering the Program, you agree that if you are a selected as a successful applicant that is disqualified and the offer is forfeited for any reason, the Program Sponsor, agent and Promotional Parties shall be fully and completely released and discharged from any liability or responsibility in this regard.
By entering the Program, the successful applicant consents to the use of his or her name, image, voice, likeness, city of residence and/or photographs without compensation in any publicity or advertising carried out in any medium worldwide by the Program Sponsor, and Promotional Parties and/or its advertising or promotional agencies without limitation or further notification or compensation.
Up to 8 offers are available to be awarded to successful applicant(s). There is no cash alternative to the whole or any part of the offer.
Each offer may include:
Breakfast at local restaurant (valued up to $20)
Lunch at a local restaurant (valued up to $30)
Dinner at local restaurant (valued up to $100)
One night of accommodation (up to max value of $150) (double occupancy)
Any applicable admission or entry tickets to event/ festivals during their tryout (up to a max value of $100)
Discretionary spending, alcoholic drinks and transportation costs will be up to the responsibility and at the sole discretion of the successful applicant.
Offer valued at approximately: $400 per offer
The offer must be accepted on an ‘as is’ basis. No substitution, assignment, redemption for cash, or transfer of any part of the prize is permitted except that the Program Sponsor and Promotional Parties, in their sole discretion and subject to applicable law, reserve the right to substitute a prize or any portion thereof with something of equal or greater value.
The Program Sponsor reserves the right, in its sole discretion to terminate or suspend the Program, or modify the Program Rules and Regulations at any time.
The offer may not be sold, transferred or assigned, and is not convertible to cash. The offer cannot be used in conjunction with any other promotion or offer.
Offers are to be redeemed by October 31st, 2019 or by dates specified in the offer package emailed to successful applicant.
Other restrictions may apply.
The odds of being selected as a successful applicant are dependent on the total number of eligible entries received during the duration of the Program Period.
LIMITATION OF LIABILITY AND RELEASE:
Release: Program Successful applicant(s) shall be required to sign the Sponsor’s Affidavit of Eligibility, Publicity Release and Liability Waiver (in the form used as of the date of Program entry, a copy of which may be obtained upon written request to the Sponsor) as a condition of being awarded the offer. Guest(s) chosen to accompany Program Successful applicant(s) shall also be required to sign the Sponsor’s Affidavit of Eligibility, Publicity Release and Liability Waiver (in the form used as of the date of Program entry, a copy of which may be obtained upon written request to the Sponsor) as a condition of being permitted to accompany the Program Successful applicant when he or she collects or uses his or her offer. The Affidavit of Eligibility, Publicity Release and Liability Waiver will confirm that the Program Successful applicant(s) and Guest(s) comply with these Rules and Regulations and meet the eligibility requirements, that they accept the offer and release and hold harmless The Corporation of the City of Owen Sound, its elected officials, officers, directors, and employees, its affiliated sponsors and prize suppliers, its advertising and promotion agencies, the Program organizers, and their shareholders, officers, directors and employees, with respect to any injury, accident, loss or death related to any aspect of the Program, the offer and its use. After being contacted regarding the release and waiver by The Corporation of the City of Owen Sound or its agent, the Successful applicant(s) and Guest(s) will have until one week prior to their tryout Owen Sound weekend date, to return the duly executed release form, by mail, to City of Owen Sound Attn: City of Owen Sound Tourism Department at 945 3rd Avenue East, Owen Sound, Ontario N4K 2K8. Failing to do so will result in another participant being selected and the original Successful applicant shall forfeit their claim to the offer and shall have no recourse against The Corporation of the City of Owen Sound or its agents, Program sponsors or promotional parties.
Exclusion of Liability: The Corporation of the City of Owen Sound, its elected officials, officers, directors, and employees, its affiliated sponsors and prize suppliers, its advertising and promotion agencies, the Program organizers, and their shareholders, officers, directors and employees, cannot be held responsible for any material, physical or emotional damage that can be linked in any way to the Prize awarded as part of the Program.
False Identity: The entry of any person using an assumed name, alias or false identity to participate in the Program will be deemed null and void and, as such, may be disregarded by The Corporation of the City of Owen Sound. Incomplete entries and entries made with multiple addresses, under multiple identities, or through the use of any device or artifice to enter multiple times will be automatically void.
Errors: The Corporation of the City of Owen Sound cannot be held responsible for any errors, incorrect or inaccurate transcription, or registration of Program entry information, nor for technical difficulties due to a server, network, hardware or software failure, a transmission problem or a loss of data or documents sent by participants. If a participant is randomly chosen during due to a system error, malfunction or defect, the offer at issue may be withdrawn and re-awarded to another participant.
Personal Information: Subject to the aforementioned, personal information gathered in the context of the Program will not be used by The Corporation of the City of Owen Sound except for the purpose of administering and conducting the Program, and for no other purpose without consent, unless the person chooses to opt-in to receive further communication. In supplying this information, participants’ consent to The Corporation of the City of Owen Sound use of all such information for the purposes indicated above.
If applicable, the Successful applicant is responsible for reporting any taxable benefits as a result of winning this Program to relevant tax authorities.
This Program is governed by the laws of Ontario and the laws of Canada applicable therein, and is subject to all applicable federal, provincial and municipal laws and regulations.

The Program Sponsor is collecting personal information about entrants for the sole purpose of administering this Program, unless otherwise provided for by the Program Rules and Regulations. The entrant’s personal phone number and email will be used for the sole purpose of contacting the successful applicant. The successful applicant’s personal information will be used in accordance with the Program Rules and Regulations.
